Step 2: Service Level Agreement (SLA)

1. Agreement / Contract

- This agreement is in addition to DYY LTD contractor company.
- Contract start date:
- DYY LTD will hold and review both contracts as required. This is a contract for services, where drivers are independent contractors. This is no way an offer of employment.

2. Service Objectives

The main elements of the services to be covered by this agreement are:

- The objective of this Agreement is to secure transportation of goods to customers and perform all courier duties according to the contractor’s company.
- Due to the nature of the business and the critical importance of timely delivery to the destination, transportation must be provided by a suitably trained courier/driver, who accompanies the package from the time of collection until handover to the destination representative.

3. Service to be covered

The main elements of the services to be covered by this agreement are:

- Collections of parcels, timed deliveries, all other deliveries, working in accordance to the contractors of DYY Ltd performing courier duties.
- Drivers free to provide services when they wish. A rota is available to be part of. Drivers who hire vehicles through DYY Ltd may be requested to return the vehicle to their on site manager to be off hired in cases when they cannot provide their services for a minimum of 3 days per week or have repeated absences of more than 3 times.

4. Location

- All consignments must be delivered as stated on each parcel, unless otherwise advised.
- DAs must always log in at the start and log out at the end of their day.

5. Quality Management

- Full attendance of scheduled driver meetings
- Inspection of goods/parcels (e.g., free from damage) before beginning transportation to destination
- All DAs are required to carry out a background check and Drug & Alcohol test this is charged at a one-off fee of £49.00
- A Hi-Vis vest will be provided for a fee of £5.00 and must always be worn.
- Working hour daily limits: DSPs should ensure that DAs do not drive more than 10 hours or work more than 11 hours on any day.
- Working hour weekly limit: DAs must not offer delivery services for more than 60hrs/week.
- Minimum break time per day: DAs are free to take breaks when and for how long they want (provided reasonable given the services they have agreed to provide), but DSPs should ensure that, as a minimum, DAs take a break of at least the 30 minutes rest after they have been on the road for 5:30hrs and a total of at least 45 minutes if they have been on the road for 8:30hrs.
- Minimum rest time between consecutive working days: 10 hours.
- Record Keeping: DSPs must record DA hours on a weekly record sheet.
- Maximum consecutive working days: 6 days/week.

6. Training

Staff and regular transport drivers must receive instruction and understand their responsibilities including:

- Individual drivers must read and acknowledge their understanding of their requirements
- All DAs are required to wear a DYY Ltd HI-VIS vest these must be worn at all times. Replacements are chargeable.
- Training will be provided by DYY LTD
- A key chain must be used at all times.
- All responsibilities must be fully understood before transporting goods
- DAs will be provided with a driver and safety handbook and must complete the relevant courses in order to drive. These must be completed on an annual basis and areas re-visited every month.

7. Transportation

To ensure the safety of the courier, general public and recipient:
- The drivers must always have photo card ID or other ID as deemed appropriate on their persons during working days.
- DA is not currently disqualified from driving (this includes having their license suspended)
- DA does not have more than 6 penalty points (endorsements) on their driving license.
- DA has not committed driving related offences of any kind in the last 5 years in relation to:
Offence Codes CD40, CD50, CD60, CD70, CD80 or CD90.
Offence Codes DD40, DD60, DD80, DD90.
Offence Codes DR10, DR20, DR30, DR40, DR50, DR60, DR70, DR80, DR90.
Offence Codes DG10, DG20, DG30, DG40, DG50, DG60, DG70, DG80, DG90.
Offence Codes IN10, MS40, MS50, MS60, MS70, MS80 or TT99.
Offence Codes UT (All ‘UT’ prefixed conviction codes).
Offence Codes AC (All ‘AC’ prefixed conviction codes).
- DA has not been disqualified from driving during the last 3 years or has been convicted of or has a pending prosecution for any offence or combination of offences which resulted in more than 9 points being endorsed on their driving licence.
- The driver must not remove or tamper with the consignment or its contents
- There must be no subcontracting to companies which are not approved by DYY LTD
- The driver must not have passengers unless they are onboarded with Amazon throughout the working day. No children must accompany any DAs during their working day.
- Any vehicle hired through DYY Ltd cannot be used for travels outside of England (Scotland, Wales, Northern Ireland and any part of other countries)
- All owner driver vehicles used to provide the service must be reliable and maintained in a legally roadworthy condition with appropriate breakdown cover. It is the driver’s responsibility to alert DYY LTD of any concerns or situations which may affect the safety and the duties of the day.
- All owner drivers must have the appropriate insurances, vehicle’s certificate of motor insurance for the carriage of goods for hire and reward, Goods in Transit (£25k) and Public liability (£5million). All certificates must be presented to your OSM at least 48 hours before the vehicle is scheduled to start being used for the services.
- At all times, the DA must follow all road traffic and transport laws and any requests by the Police.
- Appropriate motor insurance will be provided to any driver who hires a vehicle from DYY Ltd. The DA shall alert DYY Ltd of any changes to medical conditions including, road offences or insurance claims which may affect insurance cover or driving ability.
- Any vehicle hired through DYY Ltd carry a charge per week charge that can be found within your on hire documents. A deposit of £500 is payable and a payment plan for this can be arranged with your OSM and [email protected]. We will retain the deposit for 30 days following a DA off hiring a vehicle and leaving DYY Ltd or becoming an Owner Driver. This will allow sufficient time to obtain any off hire damage estimates if needed and to cover any fines received. Any shortfall outside of the deposit held will be invoiced in accordance with your Non Mandatory Deduction form. Any balance still held on the deposit will be returned accordingly in 30 days. The deposit is transferable to any vehicle on hired with DYY Ltd.
- DYY Ltd will be notified of any fines such as speeding tickets, parking fines etc. The DA will take full responsibility for paying all fines in full including any admin charges passed on by the hire company.
- In the event of a breakdown the DA must inform DYY Ltd as soon as possible (full processes within your driver and accident handbook).
- The DA will be liable for all breakdown costs where it is deemed driver error/fault
- The DA must inform DYY Ltd of any loss or damage to the consignment as soon as possible.
- The DA must not carry any animals in their vehicle
- The DA or any passenger must not smoke in the vehicle, full valet charges applicable if this occurs.
- The DA will be held responsible and face repercussions for all damages to the vehicle and property of DYY Ltd, unless proven otherwise.
- The DA is responsible for the cost of all repairs that fall within the insurance excess of the vehicle. These will be deducted directly from their self billed invoice. Repair costs of damages which were not reported to DYY and are not connected to a vehicle incident will be passed to the DA.
- Damages and accidents claimed through the Fleet Insurance policy incur a £2,500.00 standard insurance excess. The DA is liable for the £2,500.00 excess.
- Additional insurance excess of £500 will apply for applicants who hold an EU licence.
- Additional insurance excess of £250 will apply for applicants aged 23-24 years old.
- Additional insurance excess of £500 will apply for applicants aged 21-22 years old.
- Additional insurance excess of £500 will apply for applicants who hold a UK/EU licence for 12-24 months.
- Additional insurance excess of £500 will apply for applicants with 3 points on the licence (UK licence).
- Additional insurance excess of £1000 will apply for applicants with 6 points on the licence (UK licence).
- The insurance excess does not cover loss of use or admin fees whilst the vehicle is undergoing repairs. In the event loss of use and admin fees are charged and the insurance claim is a FAULT claim the DA will be liable for these costs in addition to the insurance excess.
- In the event the DA or DYY Ltd terminate this contract, the full amount of any costs will be deducted from the last remittance or monies retained as per the on hire agreement.
- In the event any damage or excess fees are not cleared in a reasonable time frame we reserve the right to pass the debt onto a debt recovery agency.
- When a vehicle is ON or OFF hired to a Delivery Associate the rental agreement may need to be completed without the driver present. In the event this happens an email or message will be sent when the agreement is ready to view via your DYY app profile. Please take time to review the agreement and read all the terms and conditions. The DA will have 48 hours to respond in writing with any queries or disputes. After this time DYY Ltd will assume the DA has accepted all the terms and conditions of the rental agreement.
- In the event a DYY vehicle had to be recovered from any location rather than the one that the company requested following the termination of the contract, a delivery fee of £250 will be payable. The DA is liable for that cost.
- In the event a DYY vehicle has been off hire and fuel differences were noted, the DA is liable for the cost of the missing fuel at the rate of £2.70 per litre plus an admin fee of £35
- In the event a DYY vehicle has a breakdown due to the engine running with low level of adblue, the DA is responsible for all costs related to the repair and refill of adblue tank. A minimum charge of £250 will apply if a vehicle comes off the road following this event. A loss of use charge will also apply at the rate stated on the on hire agreement.

8. Confidentiality

- Unless given explicit permission from DYY Ltd, the driver will not divulge the location of the collection and/or delivery to anyone outside other than recipient unless specified by DYY Ltd or contracted company. The only acceptable exception is at the request of a uniformed member of the police whilst they are carrying out their duty.

9. Invoicing & Payment

- All DAs are expected to provide DYY Ltd with their UTR Number (Unique Tax Reference) failure to do so will result in no work. It is the responsibility of the DA to ensure he/she pays taxes.
- DAs are not entitled to any sick pay, maternity pay, paternity pay or any other pay other than for work carried out.
- DAs will receive a remittance on a Wednesday to receive payment on the following Tuesday weekly. This allows the DA adequate time for any queries they may have with their remittance.
- Your first pay will be made upon completing your 2nd week and this will be for your 1st weeks work.
- Your van deductions if renting the van from DYY Ltd will be deducted from your remittance along with any other deductions applicable.
- Your rate card is included in the contract appendix – please familiarise yourself with this.

10. Compliance

DYY Ltd will demand assurance that the procedures and practices of the driver will satisfy the requirements of this Agreement.

- Due care and caution in the operation of delivery vehicle and strict compliance with all safe driving rules of the road, including all speed limits, posted directional signs and parking regulations. Under no circumstances will the vehicle be operated under the influence of drugs or alcohol or when physical or mental condition may be otherwise impaired.

11. Notice Period

In the event of leaving (including going on holiday), you the DA must provide DYY LTD with a 14-day notice period for the off hire of the van. If not, charges will apply as per the on hire agreement.
If the DA is to become an owner driver and will be using their own vehicle to provide services, a 14-day notice period for the DYY Ltd vehicle is also required. The required insurance documents must be presented to the DYY Ltd on site manager at least 48 hours before the vehicle is scheduled to start being used for the services.

DYY Ltd have the right to immediately terminate any DA contract, termination can be for:

- Theft
- Aggression
- Verbal or physical abuse
- Misuse of the hire van
- Change in your license
- Failure of D&A testing
- Driving without the relevant insurances


Schedule 1 - DYY Percentage For Deductions

Where deductions are made by The Company from The Supplier’s invoice, this will be calculated based on the value of the invoice submitted as explained below.

Deductions will be made from The Supplier’s invoice in the event of The Supplier owing The Company monies for reasons including, but not limited to, vehicle and property damage.

We require payment to terms. Payment must be made on time, in full, and without any deduction, off set or counterclaim. In the event that an account is outstanding, we will refer the matter to our debt collection agents, Daniels Silverman Limited, which will incur additional costs. The additional costs incurred to collect the debt will be added to the debt, plus VAT at the prevailing rate. You agree that you will be legally liable to pay the outstanding account plus additional costs, and that payment of the same can be enforced against you in court. If applicable, you also agree to pay compensation and interest at the relevant reference rate, as provided for under the Late Payment of Commercial Debts (Interest) Act 1998.


Declaration

I understand the terms and conditions of this position and will abide by all rules and regulations and the contract content any breach may lead to termination as stated above.

Step 5: Stop and Search Policy

Please read the following carefully and sign and the end to confirm that you understand and agree.

This policy applies to all employees and anyone working at or visiting Amazon’s sites.

Amazon reserves the right to search you and/or any of your property on its premises (this includes Amazon’s car parks) and you agree that Amazon may search you/and or your property:

- at any time, if Amazon honestly and reasonably believes or suspects that you may be in possession of, have destroyed, tampered with, concealed or handled stolen goods or has evidence of any theft or attempted theft; or
- if it reasonably believes or suspects that you may have drugs and or alcohol and/or other inappropriate items in the workplace; or
- as part of its random searching policy; or
- when you enter or leave Amazon’s premises.

Issued badges must be worn and displayed at all times onsite.

Failure to comply with this may result in restricting your access to Amazon building


Step 6: Nondisclosure and Data Protection Agreements for contractors

During the course of your work/time at Amazon.co.uk Limited “(Amazon” and “us”), you will be invited to visit our premises, where you mayreceive information relating to Amazon that is not known to the general public and is confidential and important to us. We call this our“Confidential Information”.

Our Confidential Information includes, among other things,

- The way that we work
- The layout of our premises
- as part of its random searching policy; or
- The technology that we use including computers and machinery
- That goods that we stock and the way that they are stored
- The people we work and interact with
- The people and companies who deliver to us and collect from us
- Any details about our customers, including their names, addresses and what they buy
- Anything to do with finance
- Anything to do with advertising or marketing plans
- Anything that you hear

Our Confidential Information is very important to our business. It is vital to us that it does not become known toother companies. We will take all legal steps necessary to protect our Confidential Information.

You must agree to the following commitments;

1. You will not disclose our Confidential Information to anyone or any company.
2. You will use our Confidential Information only to make up your mind about working with us.
3. You will notify us immediately if you discover that our Confidential Information has been disclosed, however it happens.
4. All our Confidential Information will remain our property
5. You will not trade stocks or shares based on our Confidential Information.
6. You will return any materials containing our Confidential Information to us if we ask you to.
7. You also agree that you will not disclose information to us that is confidential to you or anyone else.

This is a legal agreement.

If a provision of this agreement is held invalid under any applicable law, such invalidity will not affect any other provision of this agreementthat can be given effect without the invalid provision. Further, all terms and conditions of this agreement will be deemed enforceable to thefullest extent permissible under applicable law, and, when necessary, the court is requested to reform any and all terms or conditions to givethem such effect.

Amazon.co.uk is relying upon your promise to comply strictly with this agreement. Any violation of this agreement may cause substantialand irreparable harm to Amazon.co.uk. Accordingly, without limiting any other available remedies, this agreement is specifically enforceableby Amazon.co.uk.

Any failure by Amazon.co.uk to enforce your strict performance of any provision of this agreement will not constitute a waiver of Amazon.co.uk’s right to subsequently enforce such provision or any other provision of this agreement.

I understand and agree to abide by the promises I make in this agreement to protect Amazon’s Confidential Information. I agree that mypromises also apply for the benefit of other Amazon companies.


Step 7: Medical Fitness Declaration

All couriers wishing to provide services must be medically fit enough to undertake the role as a multi-drop courier. The corerole involves a significant amount of driving and the safe manual handling, manipulation, sorting and delivery of large numbers of consignments.

Please confirm your fitness to provide services listed below by ticking eachsection and signing and dating the bottom of the form.

- I’m physically fit and able to fulfil the demands of a multi-drop courier
- I’m not taking any medication that will hinder my ability to drive or manipulate consignments in a safe manner.
- I have no medical conditions that will hinder my ability to drive or manipulate consignments in a safe manner.
- I will comply with all manual handling guidelines and not place myself in danger by using unsafe working practices.
- I have no mental or physical conditions that have not been reported to the DVLA which could affect my ability to drive safely.
- I will inform DYY Ltd if my ability to safely drive or handle consignments changes in the future.


Step 8: Drivers Licence

DVLA Share your Driving Licence Scheme

I hereby give authority for Dyy Ltd to obtain a Share Code from the DVLA on my behalf and, thereafter, to carry out checks in relation to my driving licence. I authorise such codes to be obtained and checks to be carried out on a regular basis as may be necessary, until such date as my contract with Dyy Ltd reaches an end.

EC/EEA Driving Licence Declaration Form

I hold a full and valid European Community (EC) / European Economic Area (EEA) driving licence, that meets the standard of Dyy Ltd (the company) and its client(s), and holds no points, penalties and/or endorsements for the following:

- Having caused death through careless driving when unfit through drink
- Having caused death by careless driving when unfit through drugs
- Having caused death by careless driving with alcohol level above the limit
- Having caused death by careless driving then failing to supply a specimen for alcohol analysis
- Having caused death by driving: unlicensed, disqualified, or uninsured
- Dangerous driving
- Having caused manslaughter or culpable homicide while driving a vehicle
- Furious driving
- Driving or attempting to drive with alcohol above the legal limit
- Driving or attempting to drive while unfit through drink
- Driving or attempting to drive then failing to supply a specimen for analysis
- Driving or attempting to drive then refusing to give permission for analysis of a blood sample that was taken without consent due to incapacity
- Failure to provide a specimen for analysis in circumstances other than driving or attempting to drive
- Failing to provide a specimen for a breath test
- Using a vehicle uninsured against third party risks
- Motor racing on the highway
- Aggravated taking of a vehicle
- I have not had any major preventable collisions within the previous three years


I must notify the Company if I change my licence from an EC/EEA to a UK driving licence; I understand that when the Company received my new driving licence details, a standard DVLA check will be performed and held in my file.

Step 10: Data Privacy Notice

Your personal data - what is it?

Personal data relates to a living individual who can be identified from that data. Identification can be by the information alone or inconjunction with any other information in the data controller’s possession or likely to come into such possession. The processing of personal data is governed by the General Data Protection Regulation 2016/679 (the “GDPR”) and the Data Protection ct 2018 (the “DPA").

Who are we?

DYY Ltd is the data controller. This means DYY Ltd decides how your personal data is processed and for what purposes.

How do we process your personal data?

DYY Ltd complies with its obligations under the GDPR and the DPA by keeping personal data up to date; by storing and destroying it securely; by not collecting or retaining excessive amounts of data; by not collecting irrelevant data; by protecting personal data from loss, misuse,unauthorised access and disclosure and by ensuring that appropriate technical measures are in place to protect personal data.

We use your personal data for the following purposes:-

- To enable us to enter into a contract with you by which you provide us with courier/delivery services;
- To ensure your identity and your right to work in the UK;
- To provide remittance of your invoices via third party partners;
- To manage our employees (where applicable);
- To keep personnel and contractors’ records͖
- To maintain our own accounts and records;
- To comply with our clients’ contractual requirements and provide them with a service͖
- To ensure appropriate and adequate insurance cover and to comply with insurers’ requirements͖
- To carry out background/criminal records checks as and when needed;
- To carry out regular searches of the Driver and Vehicle Licensing Agency to ensure entitlement to drive;
- To carry out Drug & Alcohol checks prior to commencing services and on an ad hoc basis throughout, until services are no longerprovided, for whatever reason.
- To provide information to statutory bodies including (but not limited to) the Police, the Home Office, Her Majesty’s Revenue &Customs, Her Majesty’s Courts & Tribunals Service, the Department for Work & Pensions and the Health & Safety Executive.

What is the legal basis for processing your personal data?

- Consent of the data subject (please see consent form for completion);
- Processing is necessary for the performance of a contract with the data subject or to take steps to enter into a contract to providecourier/delivery services;
- Processing is necessary for compliance with legal obligations (both statutory and contractual). Failure to consent to suchprocessing will render any contract voidable;
- Processing is necessary to protect the vital interests of a data subject or our clients;
- Processing is necessary for the performance of a task on behalf of our clients;
- Processing is necessary for the legitimate interests of the data controller or a third party, except where such interests areoverridden by the interests, rights or freedoms of the data subject;
- Processing is necessary for carrying out obligations under employment, social security or social protection law, or a collectiveagreement;
- Processing is necessary for the establishment, exercise or defence of legal claims or where courts are acting in their judicialcapacity;
- Processing is necessary to comply with law enforcement requirements and statutory legislation;
- Processing is necessary for reasons of preventative or occupational medicine, for assessing the working capacity of an employee,medical diagnosis, the provision of health or social care or treatment or management of health or social care systems and serviceson the basis of EU or Member State law or a contract with a health professional (applicable to employees only).

Sharing your personal data

Your personal data will be treated as strictly confidential and will be shared only with our clients, as and when necessary. We will onlyshare your data with other third parties (save for contractual or statutory obligations) with your consent.

How long do we keep your personal data?

Where a contract is entered into with DYY, we will keep your personal data for the duration of said contract. Upon termination of thecontract, we will keep your personal data for a period of 6 years and 4 months in case of any legal claims/complaints.

Where initial enquiries are made by you (or us) with a view to entering into a contract, but subsequently no contract is entered into, we will keep your personal data for a period of 3 months, in case of any potential claims to an employment tribunal.

Your rights and your personal data

Unless subject to an exemption under the GDPR and the DPA, you have the following rights with respect to your personal data:-

- The right to request a copy of your personal data which DYY Ltd holds about you;
- The right to request that DYY Ltd corrects any personal data if it is found to be inaccurate or out of date;
- The right to request that your personal data is erased where it is no longer necessary for DYY Ltd to retain such data;
- The right to withdraw your consent to the processing at any time;
- The right to request that the data controller provides you with your personal data and, where possible, to transmit that datadirectly to another data controller (known as the right to data portability);
- The right, where there is a dispute in relation to the accuracy or processing of your personal data, to request a restrict to beplaced on further processing;
- The right to lodge a complaint with the Information Commissioner’s Office.

Transfer of data abroad

We will never transfer your personal data to countries or territories outside the EU without your prior consent.

Further processing

If we wish to use your personal data for a new purpose, not covered by this Data Privacy Notice, then we will provide you with a new noticeexplaining this use prior to commencing the processing and setting out the relevant purposes and processing conditions. Where and whenever necessary, we will seek your prior consent to the new processing.

Step 11: Non-Mandatory Deduction Form

Payment Plan:

Deduction will occur weekly based on percentage deduction sliding scale.

- Not Exceeding £55 (0%)
- Exceeding £55 but not exceeding £100 (2%)
- Exceeding £100 but not exceeding£135 (4%)
- Exceeding £135 but not exceeding £165 (6%)
- Exceeding £165 but not exceeding £260 (8%)
- Exceeding £260 but not exceeding £370 (11%)
- Exceeding £370 (13%)


Declaration:

I hereby authorise Dyy Ltd to make the any deduction from my pay in accordance with the above terms if damages occur.

I understand and agree I am responsible for the satisfying the above amounts. I understand and agree that any amount that is due and outstanding at the time of working under the SLA or in regards to termination, regardless of whether the SLA termination was voluntary or not, will be deducted from my last invoice or any other amounts that may be owed to me. This authorises Dyy Ltd to retain the entire amount of my last invoices in compliance with the law.


Step 12: AMZL Delivery Associate Privacy Notice

We know that you care how information about you is used and shared and we appreciate your trust in us to do that carefully and sensibly. This Privacy Notice describes how Amazon collects and processes your personal data as a Delivery Associate in connection with the pick-up, delivery and related services (together, the "Services") which your Delivery Service Provider ("DSP") provides to Amazon.

Who is the Controller of your Personal Information?

Your DSP has a contract with an Amazon company to provide the Services. That Amazon company is the data controller of your personal information in connection with the Services you provide as a Delivery Associate (the "Controller"). If you’re unsure of the relevant Amazon company or require its contact details, please contact [email protected] or your DSP.


What Personal Information about Delivery Associates does Amazon collect, store and process?

We collect your personal information in order to facilitate and support the provision of the Services, and to continually improve the tools we provide to you and your DSP. Here are the types of information we gather:

Information you give us:

We receive and process any information you provide to us in relation to the Services. SeeExamples of Information Collected below. You can choose not to provide certain information but then you may not be eligible to perform the Services.

Information from your use of our technology:

To perform the Services, you must download and use a smartphone application called the "Amazon Delivery App" (right of use for the Amazon Delivery App granted by Amazon EU Sarl). Unless you use your own mobile device, your DSP will give you a portable device ("Delivery Device") to use when performing Services. We refer to the Amazon Delivery App, Delivery Devices, and other Amazon applications ordevices we provide your DSP or which we or your DSP installs on vehicles in connection with the Services as the "Amazon Delivery Technology". We’ll automatically receive and process certain types of information any time youare logged into the Amazon Delivery App. See Examples of Information Collected below.

Information related to your visits to Amazon Sites:

We will give you an Amazon security ID badge ("Badge"). You will need to use your Badge to access Amazon Delivery Stations or other sites at which you may pick up or return Amazon parcels (together, "Amazon Sites"). We’ll collect and process certain types of information when you visit Amazon Sites to ensure your security and the security of other personnel. See Examples of Information Collected below.

Information provided by your DSP:

Your DSP or its subcontractors may disclose documents to us that include yourpersonal information for the provision, administration or audit of the Services. See Examples of Information Collected below.

Information from other sources:

We may receive information about you from other sources, including from our service providers (including those who may provide applications or devices that Amazon or your DSP installs onvehicles in connection with the Services), customers, and government authorities such as the police or local councils enforcing speeding or parking fines. See Examples of Information Collected below.

For what Purposes and on which Legal Bases does Amazon Process your Personal Information:

We collect, analyse, store and otherwise process your personal information on the following legal bases:

- Amazon’s legitimate interests in ensuring your safety and that of others, ensuring you make customer deliveries in accordance with the highest commercial standards, and preventing fraud
- To comply with our legal obligations
- For the performance of a contract where applicable
- In specific circumstances, your consent

The purposes for which we process your personal information according to the above legal bases include:

Ensuring your safety, the safety of Amazon personnel and others:

Ensuring your safety, the safety of Amazon personnel and others: We may need to process your personal information for security reasons and in circumstances where your safety or the safety of others is at risk, for instance in the event of a fire or another emergency, on the basis of Amazon’s legitimate interests in ensuring your safety and that of others.

To do this effectively, we may need to process your geolocation when you’re on an Amazon Site or when you’re on the road performing Services. We may communicate your geolocation to emergency services so they or your DSP can get to you quickly if you’re involved in an accident. As a way to ensure that all Delivery Associates delivering Amazon parcels perform the Services safely, we may also process your data related to your compliance with road safety and health & safety rules and standards.

Assessing your eligibility to perform Services under your DSP's contract with Amazon:

We process your personal information to assess your ongoing eligibility in accordance with Delivery Associate eligibility requirements andservice standards agreed with your DSP on the basis of Amazon’s legitimate interests in ensuring your safety and that of others, ensuring you make customer deliveries in accordance with the highest commercial standards, and preventing fraud. This may include information you provide us through the onboarding process.

Managing our contractual relationship with your DSP:

We process your personal information to coordinate, manage and audit your DSP’s provision of the Services on the basis of Amazon’s legitimate interests in ensuring your safety and that of others, ensuring you make customer deliveries in accordance with the highest commercial standards, and preventing fraud, and to comply with our contractual obligations. This includes planning delivery routes, providing delivery support, tracking delivery progress, and assessing your DSP’s compliance with Amazon policies and service standards.

Communicating with you:

We process your personal information to communicate with you in connection with the Services on the basis of Amazon’s legitimate interests in ensuring your safety and that of others, ensuring you make customer deliveries in accordance with the highest commercial standards, and preventing fraud, and to comply withour legal obligations. This includes communicating with you while you deliver Amazon parcels via different channels (e.g. by phone, SMS or chat).

Fulfilling our obligations to our customers:

We may process your personal information to provide support to you, your DSP and our customers to ensure the effective completion of the Services, including managing customer complaints on the basis of Amazon’s legitimate interests in ensuring you make customer deliveries in accordance with the highest commercial standards and to comply with our legal obligations. We use your location data when you’re performing Services to keep our customers informed of the status of their collection/delivery and to enable them to see the location of their parcels.

Troubleshooting and improving our services:

We use your personal information to enhance the delivery experience for Delivery Associates and customers, including by improving mapping systems and providing driver support while you perform the Services on the basis of Amazon’s legitimate interests in ensuring your safety and that of others, ensuring and ensuring you make customer deliveries in accordance with the highest commercial standards.

To defend Amazon’s legal position:

In case of legal proceedings, we may need to process and share your personal information to establish, exercise or defend against the claim, or if compelled or ordered to do so by a court, governmental or administrative authority in order to comply with our legal obligations. We may also need to process and share your personal data in order to protect Amazon’s rights or enforce the terms of our agreement with your DSP on the basis of Amazon’s legitimate interests in ensuring you make customer deliveries in accordance with the highest commercial standards and preventing fraud.

Complying with legal obligations:

We may process your personal information in order to comply with our legal obligations or to verify or prove that we have done so. This may include processing or sharing data related to your compliance with health and safety standards and the handling of Amazon customer data on the basis of compliance with our legal and contractual obligations.

Fraud and loss prevention:

We may process your personal information to investigate, resolve and report (as appropriate) any fraud, theft or other wrong doing in relation to your performance of the Services, including Badge Swapping and missing packages on the basis of Amazon’s legitimate interests in ensuring you make customer deliveries in accordance with the highest commercial standards and preventing fraud.

Does Amazon Share Your Personal Information?

Amazon shares Delivery Associates' personal information only as described below.

Amazon group companies:

Your personal information may be disclosed by the Controller to Amazon EU affiliates, including Amazon EU Sarl and Amazon Europe Core Sarl, and additionally Amazon.com, Inc. and other subsidiaries that Amazon.com, Inc. controls. All Amazon entities we share your information with are either subject to this Privacy Notice or follow practices that are at least as protective as those described in this Privacy Notice. We only share your information with Amazon entities that have a need to know or have access to it and where lawful to do so.

Your DSP:

We may collect and share your personal information with your DSP, including your location, the number of Amazon parcels assigned to you and the number of Amazon parcels remaining on a given delivery route, customer or other complaints in which you may be involved, or your non-compliance with health & safety standards.

Third party service providers:

When we need to, we may share your personal data with third parties who provide services to Amazon, including the companies that install and manage devices on the vehicles you use when providing the Services or develop and manage applications downloaded on the Delivery Device or your own mobile device; survey companies or, where legally permissible, background check service providers. We ensure that any such third party provides guarantees that meet Amazon standards regarding the confidentiality and security of your personal information. For example, our third party providers must comply with our data security standards, data protection laws, and international transfer restrictions, may only have access to personal information needed to perform their functions and may not use it for other purposes than providing the agreed services to us.

Business transfers:

As we continue to develop our business, we might sell or buy other businesses or services. In such transactions, relevant business data (which may include your personal information) is generally one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Notice.

Compliance with Amazon’s legal and regulatory obligations:

In certain circumstances, we may be obliged to share your personal information with third parties including administrative authorities (including tax authorities), financial institutions, insurance providers, police and public prosecutors. These third parties will act as controllers of your personal information in their own right and will be responsible for compliance with applicable data protection laws.

Fraud and loss prevention:

Subject to applicable laws, we may release your personal information to law enforcement, governmental authorities or private organisations whose aim is to prevent fraud or theft when we believe such release is appropriate or necessary to (i) comply with the law; (ii) enforce our contract with your DSP;(iii) protect the rights, property, security or safety of Amazon, its affiliates, personnel, customers, or others; (iv) detect, prevent or otherwise address fraud, security or technical issues; or (v) prevent or stop activity which we consider to be, or to pose a risk of becoming, illegal, unethical, or legally actionable.

Transfers out of the EEA:

Whenever we transfer your personal information to countries outside the European Economic Area ("EEA") in the course of sharing information as set out above, we’ve put in place adequate safeguards to protect your privacy, fundamental rights and freedoms, and the exercise of your rights. . We design our systems with your security and privacy in mind.

- The Amazon Delivery Technology offers security features to protect them against unauthorised access andloss of data.
- It is important for you to protect against unauthorised access to your Amazon log-in, password and to theAmazon Delivery Technology. Be sure to sign off when you finish using a shared Delivery Device

What rights and choices do I have regarding my Personal Information that you collect and process?

You have the right to request access to, correction, deletion, or portability (i.e. request a copy for yourself or transmission to another data controller) of your personal information. Note that a deletion request will not apply to information that Amazon has a right to retain for the establishment, exercise or defence of legal claims or for compliance with its legal obligations (i.e. tax and accounting requirements). You are also entitled to object to the processing of your personal information or request its limitation in certain instances. When we process your personal information based on your consent, you may withdraw it for the future at any time. Exercising these rights may mean that you will no longer be able to perform the Services. How long do we keep your Personal Information?

We keep your personal information to enable your continued performance of the Services, for as long as we need it to fulfil the purposes described in this Privacy Notice, as may be required by law such as for tax, accounting or claims management purposes, or as otherwise communicated to you. For example, we retain your location data to enhancethe delivery experience for Delivery Associates and customers, including by improving mapping and route planning systems.

You can also file a complaint with your local data protection authority. Our business changes constantly and our Privacy Notice will change also. If the change is fundamental or may significantly affect you, we will provide your DSP with the updated Notice in advance of the change actually taking effect. We encourage you to review the content of this Notice regularly by asking your DSP for a copy of it or in the Amazon Delivery App.

Examples of Information Collected Information you give us in connection with the DSP Services.

You provide information to us when you:

- Onboard as a Delivery Associate
- Communicate and interact with Amazon personnel, including delivery support services and other Amazon support teams
- Answer Connections questions, surveys or provide other feedback to Amazon

As a result of these actions, you might supply us with such information as your name; phone number, email and address; your date of birth; your driver’s licence and ID photograph; your Delivery Associate account password.

Information from your use of Amazon Delivery Technology:

Examples of the information we collect, analyse, store and otherwise process include:

- Route data, including when you pick up and deliver packages and your progress through delivery routes
- Location data, including information about your geo-location and the device operating the Amazon Delivery App as required for location-based services
- Where permissible by local laws, we and/or your DSP may collect or receive road safety data, including telematics data such as location of the vehicle, speed, harsh braking, cornering or acceleration collected byAmazon Delivery Technology while you perform the Services
- Metrics such as your rate of successful deliveries to enable us to manage your DSP’s compliance with agreed service standards

From the moment you check into the Amazon Delivery App when beginning a scheduled delivery route until the moment you check out, we will collect and process your geolocation. Most mobile devices provide you with information about these permissions and you have the right to choose whether or not to allow Amazon to receive this information. However, as our ability to receive this information is an important part of managing our customer’s expectations and locating parcels, if you choose to deny Amazon access to this information, this could affect the availability and functionality of the Amazon Delivery App and, as a result, your ability to perform the Services under your DSP’s contract with Amazon.

Information related to your visits to Amazon Sites:

Examples of the information we collect, analyse, store and otherwise process include:

- What time you arrive at and leave an Amazon Site, for example, when collecting parcels or returning any undelivered parcels
- CCTV footage

Information provided by your DSP:

Examples of the information and documents your DSP may provide to us which analyse, store and otherwise process include:

- Information or documents provided by you to your DSP, including work permits, registration with health insurance providers, your residence permit, [For DE only: your Personalausweis ID/Ausweisdokument, your Statusfeststellung Selbständige,] your declaration that you are medically fit to perform the DSP Services,and your social security information
- Personnel administration data, including confirmation of completed safety trainings, pay slips, attendance data, your employment contract or contract of services
- [For UK/ DE/AT only: Where permissible by local laws, information regarding whether you passed a criminal background check]
- Where permissible by local laws, the results of drug or alcohol screening by your DSP or their service provider

Information from other sources:

Examples of information we receive from other sources which we analyse, store and otherwise process include:

- Amazon customer surveys, feedback and complaints
- Results of surveys conducted by third parties on our behalf
- Information on alleged traffic and parking violations
- Where permissible by local laws, we and/or your DSP may collect or receive road safety data including telematics data such as location of the vehicle, speed, harsh braking, cornering or acceleration and other vehicle diagnostics collected by devices installed on your delivery vehicle (which may be provided/managed by a third party) or by applications downloaded on the Delivery Device or the mobile device you use (which may be provided/managed by a third party) while you perform the Services.
